This Flickr Group (“Group”) has been created
in conjunction with the British Library’s exhibition entitled
“The Ramayana: Love and Valour in India’s
Great Epic” (“Exhibition”), (www.bl.uk/ramayana)
and is operated by the British Library Board of 96 Euston Road,
London NW1 2DB, United Kingdom (“We” “Us”
and “Our”). “You” and “Your”
shall mean you, the person participating in the Group.
1 General
1.1 If You contribute photographs or text (“Content”)
to the Group You are deemed to have agreed to abide by all of the
following Terms and Conditions together with any amendments thereto
(both of which are non-negotiable) under which the Group is run,
and to be bound by them. We may terminate your access to the Group
without prior notice if You are in breach of any of these Terms
and Conditions or any revised Terms and Conditions that We may from
time to time impose.
2. Your obligations
2.1 You must comply with the Group Rules set out in Schedule 1.
2.2 You warrant that you have full right, power and title to provide
the Content and allow use by Us in accordance with these Terms and
Conditions.
2.3 You agree to indemnify and hold Us harmless from any cost,
loss, liability or expense (including reasonable legal fees) incurred
by Us directly or indirectly as a result of any claim, demand, or
litigation brought against Us by any third party due to or arising
out of Content You submit to the Group.
3 Our obligations
3.1 In the event that Your Content is chosen to be displayed in
Our galleries or website, we will use reasonable commercial endeavours
to include Your Flickr screen name, a link back to your Flickr
photo-stream/profile, and the title and description of any photographs
You provide.
3.2 Any personal information will not be used, or disclosed to
third parties, except for the purposes of running the Group or otherwise
in accordance with Our Privacy Policy.
4. Rights and permissions
4.1 You hereby grant Us a non-exclusive, worldwide, royalty-free,
irrevocable licence to:
4.1.1 download (from Flickr) the high-resolution version
of Your photograph(s) for the purposes of display;
4.1.2 to use Your Content:
4.1.2.1 for display on a screen in Our galleries, and on Our
website (http://www.bl.uk/ramayana),
from 16 May to 14 September 2008 to promote the Exhibition; and
4.1.2.2 within the Group, which shall remain available as a static
site on Flickr after the Exhibition has closed.
4.2 For the avoidance of doubt, We will not use your photograph
for any commercial purposes whatsoever, or for any purposes other
than those set out in 4.1.2 above.
4.3 We reserve the right to decide what Content to display in our
galleries or on Our website, and to modify such Content if we deem
it necessary for operational reasons.
4.4 We reserve the right to terminate the Group at any stage if
We deem this necessary or circumstances arise that are outside Our
control.
5. Access to the Group
5.1 Access to the Group is provided by Flickr, and subject to the Terms of Use as provided at www.flickr.com/guidelines.gne, and the Yahoo! Terms of Service. In the event of any conflict between such Terms of Use and these Terms and Conditions, then the latter shall prevail only with regard to Our use of Your Content for the purposes set out in 4.1.2 above.
6. Applicable Law
6.1 These Terms and Conditions shall be governed by and construed
in accordance with English law. You hereby submit to and agree that
the sole jurisdiction and venue for any actions that may arise under
or in relation to the subject matter hereof shall be the English
courts.
