Living Knowledge Network Made in the Library Gallery terms

The British Library Terms for submission and use of the work for the Living Knowledge Network Made in the Library Gallery.

These terms and condition apply to the submission of artwork to form part of the Living Knowledge Network (LKN) Made in the Library Gallery (Work).

By submitting your Work, you agree to be bound by these Terms, as well as our Website and Online Services terms, Privacy Policy and the Privacy Statement Living Knowledge submissions, which are incorporated by reference.

If you do not agree with any part of the Terms, you should not participate in the submission of Work.

If you would like to submit an original Work by you or on behalf of someone for us to consider to form part of the LKN Gallery, please ensure that you have familiarised yourself with the topics and themes of the LKN Gallery.
Please note that we shall only consider submissions relevant to the themes and topics of the LKN Gallery.

1. Your submissions

1.1. By submitting a Work you warrant and agree as follows:

1.1.1. That you are the author of any Work submitted and that the content and design of such Work are new, original and created by you.

1.1.2. That you own or control all rights to the Work and its content or have procured the necessary rights and permissions for use of the Work and its content pursuant to these Terms.

1.1.3. That you have the legal right to submit such Work.

1.1.4. To British Library’s use of the Work in accordance with these Terms.

1.1.5. That you are over the age of 18. If the author of the Work is under 18, you agree that you are the parent/ legal guardian of the author or that the author’s parent/legal guardian consent has been obtained.

1.1.6. That the content of your Work does not include anyone that is under the age of 18. Work including someone under the age of 18 will only be accepted if the author of the Work is under the age of 18, and in this instance, the author should be the only person in the Work that is under the age of 18.

1.1.7. That the Work is based on a theme or topic of the Living Knowledge Network Gallery.

1.1.8. That the Work complies with the technical requirements which are as follows:

For images/ photo submissions:
a) image files are high resolution (minimum 2MB)
b) scanned or photographed in colour.

For video content submissions:
c) Clear quality footage delivered in either an MP4 or .MOV files, no other file format will be accepted.

For audio file submissions:
d) Please only submit clear audio content in an MP4 file format. No other file format will be accepted.

1.1.9. That all Work submitted complies with the eligibility requirements outlined in the submission instructions, including requirements related to originality, authorship, and use of artificial intelligence.

1.2.
You agree and accept that the British Library will not pay you for any submission of Work.

1.3. You shall submit your Work by email to Living.Knowledge@bl.uk or to the relevant member of staff at a partnering library. Submissions of Work are entirely your responsibility.

1.4. Works must not include personal information about another person, images of identifiable people, contact details, offensive material, or content that infringes someone else’s rights.

1.5. Works will be moderated and accepted or marked as unsuccessful by the moderators. If the Work is accepted it shall form a part of our digital LKN Gallery, and some accepted Work may form part of our in print LKN Gallery. Due to the amount of submissions received, we are not able to reply to submissions.

1.6.
Moderators reserve the right to dismiss any Works that have malicious intent, offensive content, that have been generated using artificial intelligence, or that are not of sufficient quality in terms of technical specification detailed at clause 1.1.8 of these Terms. Work created by artificial intelligence is prohibited.

2. Use of Works

2.1. Use of any submissions is at the British Library soles discretion, and we are not obligated to include your submissions as a part of the LKN Gallery. By submitting Work, there is no guarantee it will be featured in print or digitally.

2.2. Selected Work may be published in print and digitally (online) by the British Library and public libraries across the UK.

2.3. Selected Works may be used in communications and publicity about the LKN Gallery project, including social media posts, website content, newsletters, press or promotional materials relating to the LKN Gallery project. We will not use your Work to promote unrelated British Library activities without seeking further permission.

2.4. If you no longer want your Work to be used, please contact us at living.knowledge@bl.uk. We will consider and action reasonable requests where possible, but we may not be able to remove selected Works from materials that have already been printed, distributed, archived, published online, posted on social media, or shared by third parties.

2.5. You may opt out of promotional use by contacting living.knowledge@bl.uk.

2.6. We may display Works with the creator’s full name, first name, library authority, county, or no name, depending on the permissions provided at submission and the format of the display. For creators under 18, we will normally use first name only or anonymous credit unless a parent/legal guardian has expressly agreed otherwise.

3. Copyright

3.1. As the author the of the Work, you shall retain the copyright in your Work

3.2. You agree to waive your moral rights in any Work.

3.3. By submitting Work, you agree to grant the British Library a worldwide, non-exclusive, irrevocable, perpetual, royalty-free license to reproduce, publish, display, adapt for formatting, and sub-license the Work in connection with the LKN Gallery project for the following purposes:

3.3.1. Use in digital and print publication for display on the British Library’s premises, website, social media channels and related non-commercial publicity and promotion for the project in all forms and where relevant exhibitions related to the theme of the submission.

3.3.2. Use in digital and print publication by participating public libraries and in the LKN Gallery project as authorised by the British Library to display Work for display on the participating libraries and/ or public organisations premises, website, social media channels and related non- commercial publicity and promotion in all forms for the project as authorised by the British Library.

3.4. You agree that any submission is your own Work and will not infringe the rights of third parties including copyright, trademark, trade secrets, privacy, publicity, personal or proprietary rights. You agree to indemnify the British Library against any claim from any third party for any breach of this clause.

3.5. You agree that any person featured in your submission has given you their express consent for their image to be used, and in the case of a vulnerable adult you warrant and agree that you have the express permission of their parent or legal guardian.

3.6. We may need to check if you have the requisite permissions for all content within the Work eg pictures, music and videos, and you agree to work with the British Library to provide all the necessary information as may be required. Should you fail to provide this information, or it is established that you do not have the required permissions, the British Library reserves the right to withdraw your submission and to refrain from using your submission as a part of the LKN Gallery project.

4. Liability

4.1. To the fullest extent permitted by law, the British Library shall not be liable to you for any loss, damage or injury arising whether direct, indirect and/ or consequential arising out of your submission of any Work or the British Library’s use of such Work pursuant to these Terms.

4.2. For the avoidance of doubt, nothing in these Terms is intended to limit or exclude liability for death, personal injury, fraud caused by the British Library’s negligence.

5. General

5.1. These Terms are governed by English Law and subject to the exclusive jurisdiction of the English Courts.

5.2. The British Library reserve the right to cancel, withdrawn and/ or suspend the LKN Gallery Project at its sole discretion without notice to you, and shall not be liable to you for the LKN Gallery Project no longer being available.

5.3. These Terms including any other terms mentioned above and incorporated by reference along with any written communication we have with you regarding your accepted Work constitutes the entire contract.

5.4. This contract is between you and us, and no other person apart from the person making a submission shall have right to enforce these Terms.

5.5. In the event that any of these Terms are held to be invalid or unenforceable, the remainder of these Terms shall remain valid and enforceable.

5.6. The British Library reserves the right to update these Term from time to time, and any updated versions shall be effective once it is published.
